Updated Technology Transfer Guidelines bring greater transparency and clarity to SEP licensing markets

The European Commission’s updated Guidelines on Technology Transfer represent a step forward in enhancing transparency and clarity within patent licensing markets, specifically regarding patent pools and licensing negotiation groups. The revised guidelines introduce critical safeguards for patent pools. Most notably, they explicitly prohibit “double-dipping,” ensuring that pools cannot effectively charge licensees multiple times for the same licensed patent. Furthermore, the guidelines reaffirm that pooled rights must be offered on Fair, Reasonable, and Non-Discriminatory (FRAND) terms.
